Module 1: MEDIATION. Tips

Updated: Dec 22, 2025

🌍 Mediation Masterclass: Environment & Energy

What is Mediation? Mediation is not translation. It is the ability to read information in one language (Spanish) and make it accessible to someone in another language (English).

The Golden Rule: Always ask yourself Who (audience), What (content), and Why (purpose).

🟢 LEVEL C1: Advanced Mediation

Topic: Community Solar Energy (Autoconsumo Colectivo)

1. The Exam Task

Context: You live in a building in Madrid. Your English neighbor, Sarah, missed a meeting about installing shared solar panels. She is skeptical about the cost and hassle. Task: Write an informal email (approx. 150 words) based on the brochure below. Clarify it is a collective installation, explain the economic benefits, and reassure her about the process.

Input Text (Spanish):

Folleto: "Tu Edificio, Tu Energía"¿Qué es? Instalamos paneles en la azotea común. La energía se reparte. ¡Si no quieres participar, no pagas nada!

2. Strategy & Tips for Students

A. Register Shift (Sales → Advice) The text is a brochure trying to sell something ("¡Ahorro inmediato!"). Your email is to a friend. You must soften the tone.

  • Don't write: "It has immediate profitability." (Too formal/robotic).

  • Do write: "You'll start saving money from day one." (Natural/Friendly).

B. Explaining Technical Terms Sarah might not know what "Excedentes" or "Vertido a la red" means. Don't just translate the word; explain the concept.

  • Concept: Surplus energy sent to the grid for money.

  • Model Phrase: "The best part is that any power we generate but don't use gets sent back to the grid, and they actually pay us for it."

C. Filtering Information Sarah is skeptical about the cost and hassle. Focus on that.

  • Key Point: "No works in the house" → This is crucial to reassure her.

  • Key Point: "If you don't participate, you don't pay" → This removes the risk.

3. Model Answer (The Development)

Subject: Quick update on the solar panel meeting!

Hi Sarah,

I missed you at the community meeting yesterday! I know you were skeptical about the solar panels, specifically regarding the cost and the mess, so I grabbed a brochure to double-check the details for you.

Basically, the proposal is for "collective consumption." This means the panels go on the communal roof, not our individual balconies. The most important thing mentioned is that no internal works are required inside our apartments; everything connects directly to the building's central meter, so you won't have workmen drilling in your flat.

Financially, it actually looks quite safe. The brochure claims we could see a 40% drop in our electricity bills. Plus, EU subsidies are currently covering half of the installation costs. Even better, regarding the "surplus" energy (the power we generate but don't use), the electric company essentially buys it back from us as a discount on our bills.

Also, don't worry—if you decide not to sign up, you don't pay a penny. It’s completely voluntary.

Let me know if you want to see the leaflet!

Best,

🟣 LEVEL C2: Proficiency Mediation

Topic: The Rights of Nature (Mar Menor)

1. The Exam Task

Context: You write for the international legal magazine Earth & Law. The editor needs a report on the concept of "Legal Personhood" for ecosystems, citing the Mar Menor case. Task: Write a formal report (approx. 200 words). Synthesize the shift in legal perspective (Object vs. Subject), outline the practical implications (Guardianship), and explain the global significance.

2. Strategy & Tips for Students

A. Nominalization (The "Academic" Shift) C2 writing is dense. Turn verbs into nouns to sound authoritative.

  • Spanish: "Deja de ser tratado como un objeto."

  • English C2: "This marks a shift away from the objectification of the ecosystem."

  • Spanish: "Independientemente del valor que tenga..."

  • English C2: "Irrespective of its utilitarian value..."

B. Systems Thinking When mediating complex environmental topics, use "systems" language. Just as the Greenhouse Effect is a system of trapping heat, this law is a system of trapping accountability.

  • Tip: Use words like mechanism, framework, paradigm, and implementation.

C. Handling Abstract Concepts You need to explain the difference between Object and Subject.

  • Object: Something we use/protect (passive).

  • Subject: Something that has rights/agency (active).

  • Model Phrase: "It grants the lagoon legal standing, elevating it from a resource to be managed to a subject with inherent rights."

3. Model Answer (The Development)

Report: The Mar Menor and the Evolution of Ecological Jurisprudence

Introduction This report outlines the groundbreaking legislation granting "Legal Personhood" to the Mar Menor lagoon in Spain. This case represents a watershed moment in European environmental law, establishing a precedent for "Ecological Justice."

A Paradigm Shift: From Object to Subject The core of this legislation is a fundamental shift in legal perspective. Historically, environmental law has been anthropocentric, protecting nature only insofar as its destruction affects human property or health. The Mar Menor manifesto explicitly rejects this objectification. It posits that the ecosystem possesses an inherent right to exist, evolve, and regenerate, irrespective of its utilitarian value to humanity.

Practical Implications: Legal Guardianship In practical terms, the law grants the lagoon distinct legal personality, similar to that of a corporation. This mechanism establishes a system of legal guardianship composed of scientists and citizens. Consequently, these representatives hold the authority to file lawsuits directly on behalf of the lagoon. The ecosystem is no longer dependent on the state to protect it; it has acquired the agency to defend itself against degradation.

Conclusion By recognizing nature as a subject of rights rather than a mere resource, this legislation offers a robust new framework for combatting environmental collapse.
